These Terms & Conditions ("Terms") govern your access to and use of simconnecta.com (the "Website") and the services made available through the Website. The Website and the services are operated by MIRAXIS LTD. In these Terms, "SimConnecta", "we", "us" and "our" refer to MIRAXIS LTD.

By creating an account, purchasing or activating an eSIM, or otherwise using the Website, you agree to these Terms. If you do not agree to these Terms, you must not use the Website or the services.

1. About SimConnecta

SimConnecta is an online platform through which users can purchase and manage digital eSIM services and mobile data plans for supported destinations.

Depending on the selected plan, an eSIM may provide mobile data connectivity in one or more countries or territories through one or more local mobile network operators.

The availability, speed and quality of mobile connectivity may depend on local network infrastructure, network coverage, device capabilities, geographic location, congestion and other factors outside our direct control.

Users purchase specific eSIM packages directly through the Website by selecting the package they wish to buy, adding it to the shopping cart and paying the full order price at checkout.

2. Age and Eligibility

You must be at least 18 years old to create an account or use SimConnecta services.

By creating an account or using the services, you confirm that you are at least 18 years old and have the legal capacity to enter into a binding agreement.

You also confirm that the information you provide is accurate and current, that you use the services only for lawful purposes, that you do not act on behalf of another person without proper authority, and that you will comply with these Terms and applicable law.

We may request additional information where reasonably necessary to confirm age, protect account security, prevent fraud, verify payments, or satisfy applicable legal or compliance requirements.

If we become aware that an account is held or used by a person under 18, we may restrict or terminate access to that account.

3. User Accounts

Certain features of the Website require a registered account.

You are responsible for providing accurate registration information, maintaining the confidentiality of your login credentials, keeping your contact information up to date, and all activity carried out through your account unless caused by circumstances for which we are legally responsible.

Each user should maintain only one personal account unless otherwise expressly approved by SimConnecta.

You must notify us promptly if you believe that your account has been accessed or used without your authorisation.

We may restrict or temporarily suspend access to an account where reasonably necessary to investigate suspected unauthorised access, fraud, abuse or a material breach of these Terms.

4. eSIM Services

An eSIM is a digital SIM profile that can be installed on a compatible device.

Before purchasing an eSIM or data plan, you are responsible for checking that your device supports eSIM technology, that the device is unlocked where required, that the selected plan covers the intended destination, and that the selected data allowance and validity period are suitable for your needs.

Information regarding destination coverage, data allowance, validity and other material characteristics of a plan will be displayed on the Website before purchase.

5. eSIM Delivery and Installation

eSIM products are supplied digitally.

Following successful purchase, activation or fulfilment, the relevant eSIM installation information may be made available through the user account, by email, through a QR code, through manual installation details or by another electronic method indicated on the Website.

Users must follow the installation instructions provided. Users should not delete an installed eSIM unless they are certain that it can be reinstalled. Certain eSIM profiles or plans may be installable only once.

If an eSIM cannot be installed, activated or used, or if you have another technical question relating to an eSIM, please contact [email protected].

6. Activation and Validity

The activation conditions and validity period of an eSIM plan may vary depending on the product.

A plan may begin when the eSIM connects to a supported mobile network, when the eSIM is activated, on the date specified in the product description, or according to another activation rule clearly displayed before purchase.

The applicable activation and validity rules shown for the relevant eSIM plan form part of the contract for that purchase.

Unused data ordinarily expires at the end of the applicable validity period unless the relevant plan expressly provides otherwise.

7. Network Availability

Mobile connectivity is provided using third-party telecommunications networks. Network coverage may therefore vary depending on location, local infrastructure, device, frequency support, network congestion, maintenance and other technical conditions.

We do not guarantee uninterrupted connectivity, a particular network speed or universal coverage in every part of a supported country.

Nothing in these Terms excludes or limits any statutory rights that cannot lawfully be excluded.

8. Direct eSIM Purchases

To make a purchase, select the eSIM package or packages you wish to buy, add them to the shopping cart, review the order details and pay the full order price using an available payment method at checkout.

Each payment is made for a specific order and the eSIM package or packages identified in that order. Payment covers the selected products and services only.

The maximum purchase amount is EUR 2,000 per order.

9. Payment Processing

The available payment methods, payment currency and total amount payable for the selected eSIM package or packages will be displayed before the user confirms the order.

Any applicable currency conversion, payment charges or other charges will be disclosed where required before the user confirms the transaction.

Payments may be processed through third-party payment service providers. We do not store complete payment card details where these are processed directly by an authorised payment service provider.

Orders are processed after successful confirmation of payment. We may delay order processing or fulfilment while a transaction is undergoing payment, security or fraud review. Further purchase and payment rules are contained in our Purchase and Payment Policy.

10. Prices and Payments

Prices applicable to eSIM products are displayed on the Website before purchase.

The Website may support different currencies or payment methods. Before completing an order, users will be shown the total amount payable for the selected eSIM package or packages.

Users are responsible for reviewing the order before confirming payment.

Any taxes, charges or fees that must legally be included in the displayed price will be handled in accordance with applicable law.

11. Digital Supply and Cancellation

eSIM products are delivered electronically and may be supplied or activated shortly after an order is completed.

Where applicable consumer law provides a cancellation period, we will comply with those statutory requirements.

Where a user expressly requests that digital content or a digital service be supplied or performed immediately during an applicable cancellation period, the user may be asked to expressly consent to immediate supply or performance and acknowledge the effect that immediate supply or full performance may have on the statutory cancellation right.

The user's statutory rights are not affected by these Terms.

The detailed rules relating to cancellations, faulty services, technical problems and refunds are contained in our Refund & Cancellation Policy.

12. Refunds

Refund eligibility depends on the circumstances of the relevant transaction.

A refund may potentially be available where, for example, an eSIM was not delivered, a verified technical defect prevented the service from being used, the purchased service materially differed from the description provided, or a refund is otherwise required by applicable consumer law.

Different rules may apply after an eSIM has been installed, activated or used.

Refund requests are handled under the Refund & Cancellation Policy.

13. Device Compatibility

It is the user's responsibility to check device compatibility before purchasing an eSIM.

An eSIM may not function if the device does not support eSIM, the device is carrier-locked, the device does not support required network frequencies, eSIM functionality has been restricted by the device manufacturer or mobile operator, or the user incorrectly installs or configures the eSIM.

We will provide reasonable information regarding compatibility where available.

This section does not limit any rights available to consumers where information provided by us was inaccurate or misleading or where applicable law otherwise provides a remedy.

14. Fair and Acceptable Use

Users must use SimConnecta services lawfully and reasonably.

The services must not be used for fraud or attempted fraud; unlawful activities; interference with telecommunications networks; network attacks or malicious activity; unauthorised commercial resale of an eSIM or service; attempts to bypass technical restrictions; or activity designed to cause unreasonable disruption to a network or service.

Certain mobile plans may also be subject to fair usage, network management or technical restrictions imposed by an underlying telecommunications provider. Where such restrictions materially affect a plan, relevant information will be provided where required.

15. Prohibited Activity

You must not provide false or misleading account or identity verification information; impersonate another individual; use payment information without authorisation; interfere with the security or operation of the Website; use automated methods to exploit prices or the ordering process; or use the services in violation of applicable law.

16. Fraud, Chargebacks and Payment Disputes

We may review transactions where there are reasonable indications of fraud, unauthorised activity, payment disputes, chargebacks or abuse.

During a review, processing or fulfilment of an affected order may be temporarily delayed where reasonably necessary.

If a payment is reversed or charged back, access to the eSIM or service supplied under the affected order may be restricted where appropriate and permitted by applicable law.

Nothing in this section prevents a user from exercising legitimate rights to dispute an unauthorised or incorrect payment.

17. Suspension and Termination

We may suspend or restrict an account where reasonably necessary because of suspected fraud; serious security concerns; materially false identity verification information; unauthorised payment activity; material or repeated breaches of these Terms; unlawful use of the services; use by a person under 18; or a legal or regulatory requirement.

Where appropriate, we will provide notice and an opportunity to resolve the issue.

Immediate restriction may be applied where reasonably necessary to protect users, prevent fraud or comply with law.

Termination or suspension does not remove any rights the user has under applicable consumer law.

18. Third-Party Services

Certain services may depend on third parties, including telecommunications operators, eSIM suppliers, payment processors, identity verification providers and technology infrastructure providers.

Their involvement may be necessary to provide the relevant service.

Where third-party terms directly apply to a particular product or service, any relevant material conditions will be communicated to the user where required.

19. Intellectual Property

The Website and its content, including software, text, graphics, branding, interfaces and other materials owned by or licensed to SimConnecta, are protected by applicable intellectual property laws.

You may use the Website only for its intended purposes.

You may not copy, reproduce, modify, distribute or commercially exploit protected Website content without permission unless applicable law permits such use.

20. Limitation of Liability

Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability that cannot be excluded under applicable consumer protection law.

Subject to applicable law, we are not responsible for losses caused solely by circumstances outside our reasonable control, including outages of third-party telecommunications networks, local mobile network restrictions, device failures outside our control, failures caused by incorrect installation or configuration by the user, or force majeure events.

We do not exclude responsibility for providing services with the standard required by applicable law or for services that materially fail to match the description provided to the user.

21. Complaints and Technical Support

For questions relating to eSIM installation, activation, mobile data connectivity, eSIM technical issues, delivery of a QR code or activation details, please contact [email protected].

For general, corporate or legal enquiries, please contact [email protected].

You may also contact us by telephone at +44 7537 132358.

Please provide sufficient information for us to identify the relevant account, eSIM or transaction. We will review complaints fairly and seek to respond within a reasonable period.

Submitting a complaint does not affect any statutory rights or remedies available to you.

22. Privacy

Personal information is processed in accordance with our Privacy Policy.

This includes personal information collected in connection with account registration, eSIM orders, payment processing, eSIM fulfilment, refunds, customer support, identity and age verification, and fraud prevention.

23. Changes to These Terms

We may update these Terms where reasonably necessary, including to reflect changes to our services, changes to legal or regulatory requirements, security requirements, changes to purchase or payment procedures, or changes to third-party services.

Material changes affecting existing users will be communicated where required by law.

Changes will not retroactively remove statutory rights or valid rights already accrued by a user.

The current version will be published on the Website with its effective date.

24. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

25. No Waiver

If we do not immediately enforce a provision of these Terms, this does not mean that we waive our right to enforce it later.

26. Governing Law and Consumer Rights

These Terms are governed by the laws of England and Wales, subject to any mandatory consumer protection rights available to users under the laws applicable to them.

If you are a consumer residing outside England and Wales, you may also have mandatory rights under the laws of your country of residence that cannot lawfully be excluded by these Terms.

Nothing in these Terms limits those mandatory rights.
